The ITS repatriation case came for hearing in the Hon'ble High Court Delhi on 18/12/12 AGS, Shri Mehra submitted the minutes of the meeting of Committee of Secretaries held on 12.12.2012 on Cabinet Note on which Cabinet may take decision upto 15th Jan'2013 and the same will be apprised to the Hon'ble Court.
Hon'ble High Court Delhi has posted the case on 1st Feb'2013 for hearing by extending the last date for implementation of its order upto 01.02.2013.

All the Distt and branch Secretaries are requested to ensure 100% participation in 2 days' dharna at SSA level/Cirle level under the banner of Joint Forum of BSNL MTNL Unoins and Associations on the following demands:-
1 All unabsorbed ITS officers should be forthwith relieved to DOT for the true and just implementation of absorption process or All employees absorbed/recruited by BSNL & MTNL should be taken back to Govt service and permitted to work in BSNL and MTNL on the deputation as in the case of unabsorbed ITS group A officers.
2 Ensure financial viability of BSNL and MTNL by:-
i) Immediate refund of BWA spectrum charges to BSNL and MTNL
ii) BSNL and MTNL should not be charged for the extra spectrum holding by them in excess of 4.4 MHZ.
iii) Adequate compensation for BSNL rural landline operations.
iv)Exempt BSNL/MTNL from spectrum liberalisation and reforming.
v) Justified sanction of funds from the USO fund to BSNL and MTNL and immediate release of funds from USOF.
vi)immediate procurement of equipments and materials by BSNL and MTNL.
3) Pension of retirees to be paid by government instead of MTNL as in case of BSNL retirees.
4) Immediate issue of Presedential Directive from DOT for 78.2% IDA fixation for BSNL employees.

12.12.2012: Circle Executives' Committee Meeting of AIBSNLEA Haryana Circle on 12.12.2012 held at Karnal: The Circle Executives' Committee Meeting of AIBSNLEA Haryana Circle was organised on 12.12.2012 at Gymkhana Club, Karnal in a grand manner. The CEC Meeting was attended by Sh. Prahlad Rai, General Secretary , Sh. B. Ravindranath, Finance Secretary and Sh. Devesh Sharma, Organizing Secretary (North) from AIBSNLEA CHQ side. The Open session was also organized on the occasion of CEC Meet. Shri Chandrahaas, GMTD Karnal was the Chief Guest.
Com. Dayanand Circle President Haryana welcomed all the dignitaries in his welcome address.
Com. Darbara Singh, CS Haryana in his keynote address touched the issue of financial viability of BSNL and the reasons of financial crisis in today's scenario. He appealed to stop the unnecessary expenditure in day to day working. He also stressed to strengthen the marketing channel partners and improve customer satisfaction.
Com. Shri Jogi Ram, CWC member Haryana in his address stressed to focus on data services. He appealed to all to encourage the young staff. He suggested to use the OFC network for providing lease line services. He also highlighted some cases pending with Haryana Circle Administration.
Com. Devesh Sharma, Organizing Secretary (North), CHQ in his address explained that in which manner the BSNL is suffering from the discriminatory attitude of the Govt. of India. He explained the efforts of CHQ in continuously resolving the issues of BSNL Executives. He highlighted the efforts and also role of AIBSNLEA CHQ in resolving the problems of DR JTOs/JAOs.
Com. B. Ravindranath, FS(CHQ) , in his address appealed all the members to change the erstwhile DoT mindset and serve the customers more efficiently. He also stressed out the points related to viability of BSNL and stressed to strengthen our Broadband network. He also mentioned the efforts of AIBSNLEA for DPCs.
GS AIBSNLEA, Shri Prahlad Rai , congratulated the comrades of Haryana Circle and specially Karnal SSA for organizing CEC Meeting in a grand manner and thanked the comrades for their great affection. He appreciated the efforts of Haryana Circle in the Organizational action programmes at HQ. In his detailed address Com. GS mentioned that due to un-helping attitude of the Govt. i.e. unjustified payment of spectrum charges (3G & BWA) of Rs. 18,500, non-reimbursement of licenses fee, USO Charges, OPEX Charges, withdrawal of ADC, Huge expenditure on Telegraph services, payment of interest @14.5% on notional loan of Rs. 7500 Crores to DoT has adversely affected the viability of BSNL. He informed that heavy expenditure is being made for the maintenance of 29,000 Rural telephone exchanges whereas ADC has been withdrawn. In addition of this he mentioned that field units are facing problems for non-procurement of GSM equipment, cables, telephone instruments, MLLN Modem, Broadband Modem, Drop wires etc which has affected the quality & growth of services. He explained that how the AIBSNLEA along with other Unions/Associations is continuously pursuing these viability related issues with the BSNL Management and DoT.
Com. GS stressed on the need of committed leadership in BSNL. Com GS. Further explained the burning issues at Headquarters level like ITS Repatriation process and 78.2 % IDA fitment benefit case. He mentioned that ITS absorption process should be completed by the Govt. of India , in the same manner like Group B, C or D. He explained the situation on the issues like VRS, 30% disinvestment and unbundling of last mile copper. He apprised the status of HR issues related to mainly DPCs from JTO to SDE, SDE to DE(Adhoc/Regular), DE to DGM, JAO to AO, AO to CAO & CAO to DGM(F), JTOs(C/E) to SDEs(C/E), SDEs (C/E) to EEs(C/E), VRS, Group 'A' officer absorption, Pay anomaly- Sr. are drawing less salary than their juniors, withdrawal of leave encashment, stopping of LTC etc. He also appealed to all to make the Mass Dharna successful on 17th and 18th December'2012 on the call of Joint Forum. At last he appealed all Executives' for makine every efforts with a team spirit and customer care for making BSNL a vibrant organization.
Chief Guest of the Open session Shri Chandrahaas, GMTD Karnal, congratulated the AIBSNLEA Haryana Circle Body for the grand success of the CEC meeting. He appealed all to leave the laziness and ensure to serve the BSNL with full enthusiasm. He mentioned that in Karnal SSA , the availability of BTSs have been increased from 96% to 98 %. He stressed on the need of early restoration of telephone connections. He stressed to strengthen the sales teams in BSNL and organized BSNL Melas. PARLIAMENT MARCH ON 22.11.2012
JOINT Forum of BSNL / MTNL Unions/Associations is organizing Parliament march at New Delhi and Massive Demonstration at all Circles/ SSAs level on 22.11.2012 to protest against the discriminatory attitude of the DOT administration, BSNL / MTNL managements towards BSNL/MTNL employees wherein they are absorbed after restructuring of DOT/DTS/DTO to BSNL/MTNL But about 1100 ITS are allowed to continue on deemed deputation in BSNL /MTNL till date. DOT submitted an affidavit to Hon'ble Delhi High Court to relieve non optee ITS 10% progressively in the next 10 years. it is nothing but allowing deemed deputation of non optee ITS in BSNL/MTNL till their retirement .Joint Forum strongly oppose this.

20.11.2012: Meeting of Forum of BSNL Unions/Associations :
Forum of BSNL Unions/ Associations representatives met on 19.11.2012 and discussed the actions are to be taken for successful implementation of Parliament March on 22-11-2012 and Massive Demonstration at all Circles /SSAs level on 22.11.2012. Forum decided to have maximum gathering in Parliament March by active participation of BSNL/MTNL employees. The Comrades of BSNL/MTNL stationed at Delhi and nearby Circles i.e. Haryana , UP(West), Rajasthan and Punjab circles will assemble at BSNL Corporate Office at 11:00 hrs and will start for Parliament march from BSNL Corporate Office ,Janpath by 12:00 hrs.

Hon'ble High Court Delhi has given direction on ITS repatriation issue i.e. "Court have extended the period of implementation from 30.09.2012 till 15.12.2012. Further ,Court have directed the Union of India to take a clear decision and come out with a concrete plan as to how the persons , who opted for repatriation ,are to be repatriated and in what manner . This in case the repatriation is not completed by 15.12.2012.Court have given one month time because ASG informed the court that the committee of Secretaries has been deliberating on this issue and the same is also to be placed before cabinet. 11.2012:Status of ITS repatriation Court case: Hon'ble High Court Delhi heard the ITS repatriation case today morning. Addl. Solicitor General submitted reply and presented case on behalf of the Union of India. ASG in his reply sought 10 years time for relieving 945 non-optee ITS from BSNL and 83 ITS from MTNL i.e. 10% every year in progressive manner. Hon'ble Bench told that the 10 years time demanded is "absurd" and asked that why these ITS are not opting BSNL / MTNL. BSNL's advocate mentioned that these ITS want to continue as Govt. Officer and only 62 ITS have been absorbed in BSNL. On query by Hon'ble Judge regarding number of ITS to be repatriated from BSNL and MTNL. It was informed that 945 ITS from BSNL and 83 from MTNL are to be repatriated. Hon'ble Judge immediately mentioned that 83 ITS in MTNL is meager number and they can be relieved immediately.
The Advocate from MTNL absorbed Group-'A' officers side pleaded that these non-optee ITS are given promotions against their posts illegally and depriving their promotions. Hon'ble court mentioned that their interest is being look after.
Repatriated ITS advocate requested for repatriation of all non-optee ITS and further putting them on deputation to BSNL / MTNL. Against this our advocate pleaded that this will be against the DOP&T orders. Hon'ble court mentioned that there is no difference between deemed deputation or deputation. Hence rejected the submission.
Against 10 years demand of DoT to allow deputation, our advocate strongly objected and mentioned that earlier BSNL / MTNL sought 2 years (25 months) time to relieve non-optee ITS and it was rejected by Hon'ble Court and now again asking 10 years time for relieving is not at all justified, Hon'ble court mentioned that even now it will not be given.
ASG informed about the Cabinet Note sent to Nodal Ministries and being discussed by the Committee of Secretaries and after the clearance, it will be sent to cabinet for approval.
Hon'ble Court mentioned that sending Cabinet Note will not affect the Court proceedings. However, court agreed to mention the development in the judgement.
Hon'ble Court finally directed Govt. to repatriate non-optee ITS from BSNL/MTNL upto 15th Dec'2012. In case, they are not relieved, Govt. should submit a concrete proposal/plan upto 15.12.2012 explaining that in what reasonable time they can be relieved. The case is re-notified on 18th Dec'2012. Our impleadment application is also allowed to be re-notified on 18.12.2012.

11.09.2012: Status of 78.2% IDA fitment to BSNL employees: GS, AGS(HQ) met GM(Estt.), BSNL C.O. and enquired about the status of 78.2% IDA fitment proposal approved by BSNL Board and its approval from Competent Authority. GM(Estt.) informed that 78.2% IDA fitment benefit proposal after BSNL Boards' approval has been sent to DoT today morning for the approval of Competent authority and issuance of Presidential Directive. The receipt of proposal from DoT has also been confirmed.

MT case at Hon PCAT, New Delhi: The case posted to 29thFeb: ’12 for hearing.
Notional date of promotion for the SDEs promoted in 2004 under LDCE quota: Hon High Court at Ernakulam today given judgment in favour of extending notional date of promotion w.e.f 23.01.2002 for the SDEs promoted in the LDCE quota in 2004 with similar benefits extended by Hon CAT, Banglore (for the applicants). The judgment has to be implemented in 2 months time which will be subject to the outcome of the RA pending at Hon High Court of Karnataka at Banglore.

Review application at Hon High Court of Mumbai against quashing of list no 6 & 7: The case posted to 24th Feb;’12.
SDE to DE promotion: Status of various Court cases delaying our promotions to more than 2000 DE vacancies further denying the promotion of minimum 2000 JTOs to SDE cadre in the resultant vacancies ---
a) Rule 206 related cases on fixation of seniority of SDEs in list No 1 to 5 — The contempt petition against CMD/BSNL at Hon CAT, Chandigargh bench came up on 13.01.2012 and given 4 weeks time. The contempt petition against CMD/BSNL at Hon CAT, Gwalior bench came up on 16.01.2012 and given 4 weeks time. The contempt petition against CMD/BSNL at Hon CAT, Jaipur bench came up on 18.01.2012 and will be posted again in February. All these judgements are in favour of seniority as per para 206, based on qualifying year basis. The SLP filed by BSNL against the judgement of Hon CAT, Jaipur bench upheld by the Hon Rajasthan High Court is coming up in the Hon Supreme Court for admission on 27.01.2012.
b) Hon CAT, Jabalpur Bench stayed convening of DPC forAdhoc DE promotion till the next date of hearing, ie 26.03.2012.
c) The review application filed by BSNL in the Hon Mumbai High Court against the quashing of seniority lists 6 & 7 is coming up for admission on 27.01.2012. BSNL filed SLP also in the Hon Supreme Court in this regard. The Regular & Adhoc promotion to DE cadre is held up since August 2011 due to the quashing of seniority lists 6 & 7 by the Hon CAT, Mumbai Bench as SC/ST candidates are available only in list no 6 & 7. The appeal in the Hon High Court of Kerala on the same matter is reserved for judgment. The appeal in the Hon High Court of Punjab & Haryana is also pending.
